Fitting of a XTR FD-M970 front derailleur*

A while back a cheap XTR E-type front derailleur came up on ebay and this seemed like a good chance to swap out the old LX that came on the second hand frame I bought.

This all seemed pretty simple, I pulled off the cranks, unbolted the LX and bolted on the XTR derailleur. I run a 2x9 set up and for the life of me I couldn't get the chain not to rub from the 4th gear at the back, on the bottom of the cage. As this is an E-type bolted into the bottom bracket/frame I can't just slide it up to solve my problem.

Zin mentions some E-types have two positions but doesn't elaborate any further, after looking on the
Shimano website it seems there is an oval shaped piece that sits behind the hole with the red circle (in the picture I've uplodaded). I've rotated this around and I'm pretty happy with the clearance - is this what is meant by the "two positions"? If neither spot worked could you run the derailleur without this extra bolt in?
